1. GENERAL

1.1
The website www.seger.se and the webshop available on the website are provided by Seger Europe AB, Jordgubbsvägen 24, 523 61 Gällstad, Sweden, corporate registration number 556244-8901, VAT number SE556244890101.

1.2
These general terms and conditions apply to purchases made by consumers on the Website. By visiting and placing an order on the Website, you confirm that you are making your purchase as a consumer and that you accept and consent to the content of these Terms. You also warrant that the information you provide about yourself is accurate. Therefore, ensure that you have read and understood the Terms before placing your order.

1.3
We reserve the right for any image or typographical errors on the Website and have the right to correct such errors and amend or update the information at any time. We also reserve the right to change the Terms without prior notice by posting new Terms on the Website. The version of the Terms applicable to your order is the version available on the Website at the time you place your order.

1.4
These Terms do not limit your statutory rights as a consumer. If applicable law grants you more extensive rights than those set out in these Terms, you may always rely on your statutory rights.

2. ORDERS

2.1
You must be at least 18 years old and a consumer to make purchases on the Website.

2.2
When you place an order, you will receive an email confirming that we have received your order. This email only confirms that we have received your order and does not constitute an acceptance of your order. The purchase agreement is concluded only once your payment has been approved, your order has been processed, and we send you an order confirmation by email. We reserve the right to decline your order for any reason. We also reserve the right to cancel an accepted order if the item you ordered is out of stock, your invoicing information is incorrect, you are not a consumer, we cannot deliver to the stated delivery address, the product has been listed at an incorrect price on the Website, we have reason to suspect fraud, you are under 18 years old, due to a Force Majeure event (see section 11), or if the customer has acted in bad faith (e.g., errors the customer knew or should have realized, such as incorrect price information).

2.3
If we decline or cancel your order, we will contact you and, if possible, make reasonable efforts to find an alternative solution.

2.4
Once your order has been placed and accepted in our system, we may have technical difficulties cancelling or amending your order. If you wish to amend a confirmed order, please contact our customer service and we will do our best to assist you. (Please note that you may need to receive the order and return it if you change your mind after the order has been confirmed.)

3. PRICES AND VAT

3.1
All prices on the Website include value added tax (VAT) and exclude any delivery charges.

3.2
We reserve the right to amend prices on the Website without prior notice.

4. PAYMENT

4.1
We offer secure payment through Shopify Payments. You may choose to pay by card, Klarna, Shopify Pay or Google Pay. For invoice payments, the invoice will be sent by email once the order has been dispatched, with a payment term of 30 days. By choosing to pay via Klarna, you accept these Terms as well as Klarna’s user terms and Klarna’s processing of your personal data; see www.klarna.com/se.

5. DELIVERY

5.1
Orders over SEK 499 are shipped free of charge. For all other orders, a shipping fee of SEK 75 will be charged. Delivery costs and delivery methods may vary from time to time (e.g., during promotional campaigns).

5.2
Orders placed on the Website are dispatched from our warehouse in Gällstad. We ship orders every business day and aim to deliver your order as quickly as possible. Delivery times may vary, but the estimated delivery time is stated in the summary before you complete your order, as well as in your order confirmation. The stated delivery time is not binding for Seger.

5.3
To avoid delivery delays, ensure that you provide accurate information at checkout. All orders are shipped with trackable delivery, and you can follow your package using the tracking information provided in your order confirmation. If you have any questions about your delivery, or need help locating your package, please contact our customer service.

5.4
Packages delivered to a delivery point and not collected will be returned to Seger. You will be charged the return shipping and handling fee of ? SEK.

6. RIGHT OF WITHDRAWAL

6.1
You have a statutory right of withdrawal, meaning that you may withdraw from the agreement (i.e., a purchase made on the Website) without providing any reason within 14 days. The withdrawal period expires 14 days from the day on which you or a third party designated by you, other than the carrier, physically takes possession of the goods (if your order is delivered in separate consignments, the period is calculated from the day you or a designated third party, other than the carrier, physically takes possession of the last item).

6.2
If you wish to exercise your right of withdrawal, you must send us a clear and unambiguous notice of your decision to withdraw from the agreement (e.g., a letter sent by post or email). You may use the template made available here, but you are not required to do so.

6.3
To meet the withdrawal deadline, it is sufficient that you send your notice of withdrawal before the withdrawal period expires. The returned goods do not need to be received by Seger before the deadline expires, but must have been dispatched within this period.

6.4
If you withdraw from the agreement, we will refund all payments received from you, including delivery costs (excluding any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery we offer). The refund will be made without undue delay and no later than 14 days from the date we were informed of your decision to withdraw. We will use the same payment method for the refund as you used for the initial transaction unless we have expressly agreed otherwise. You will not incur any fees as a result of the refund. However, we may withhold the refund until we have received the goods back from you or until you have provided proof that you have returned the goods, whichever occurs first.

6.5
You are liable only for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

7. VOLUNTARY RETURN POLICY

7.1
In addition to your statutory right of withdrawal, Seger offers a voluntary return policy allowing you to return items purchased on the Website within 30 days from the date you receive the items. Items you return must be unused and undamaged, and must be returned in their original packaging together with tags, labels, hangtags, etc. included with the purchase.

7.2
Provided you follow our instructions, we will refund the price of the item within ten business days from the date we receive your return at our warehouse and have processed the return. Refunds are issued using the same payment method used for the original purchase.

7.3
Keep your return receipt until we have notified you that your return has been processed, as it is your proof of dispatch.

7.4
If you wish to exchange an item for a different size or colour, please return the item and place a new order in accordance with your preferences. You may also contact our customer service for assistance.

8. RETURN SHIPPING

If you wish to return an item (whether exercising your statutory right of withdrawal or our voluntary return policy), contact our customer service and we will provide you with a prepaid return label. We will cover the cost of returning the item if you use the prepaid return label and follow the return instructions. Otherwise, you will bear the direct cost of returning the item.

9. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL AND RETURN POLICY

9.1
Please note that the right of withdrawal and our voluntary return policy do not apply to the following items:
a) Products manufactured according to the consumer’s specifications or clearly personalised.
b) Sealed products which, for health protection or hygiene reasons, are not suitable for return and which have been opened after delivery.

10. COMPLAINTS

10.1
You have the right to make a complaint about an item that, upon delivery, is defective or does not correspond to your order. If you receive a defective item, you must notify us of the defect as soon as possible, and no later than two months after you discovered (or ought to have discovered) the defect.

10.2
Seger is liable for defects that existed at the time of delivery and that you report within three years from the delivery date. A defect that becomes apparent within six months from the delivery date is presumed to have existed at the time of delivery unless otherwise demonstrated or incompatible with the nature of the goods or defect. The right to complain does not include defects or damage caused by normal wear and tear.

10.3
If you wish to make a complaint, you must follow the same steps as for a return.

10.4
If you return an item that you believe is defective, we will examine the item and—if we agree that the item is defective—either repair it, replace it, or refund its price. Your return is free of charge provided the complaint is approved and you use the prepaid return label and follow the instructions included with your shipment. Any replacement item will be sent free of charge. If the complaint is not approved, we will charge a fee of SEK 150 to cover our costs.

11. FORCE MAJEURE

11.1
Seger is not liable for failure or delay in the performance of its obligations if such failure or delay is caused by an event beyond our reasonable control, including but not limited to flooding, fire, earthquake, strike or other industrial dispute, accident, epidemic, pandemic, war or acts of war, civil unrest, riot, actual or threatened terrorist attack, or government decisions or regulations (“Force Majeure Event”).

11.2
We will contact you in the event that a Force Majeure Event affects our ability to fulfil our obligations to you. If your delivery is affected by the Force Majeure Event, we will reschedule the delivery to a date as soon as reasonably possible after the Force Majeure Event has ceased. Alternatively, you may cancel the purchase by notifying us.

12. PERSONAL DATA

13. GOVERNING LAW

13.1
These Terms, and purchases made on the Website, are governed by Swedish law, excluding its conflict-of-law rules and excluding the Swedish Act (1987:822) on International Sales of Goods (CISG).

14. DISPUTE RESOLUTION

14.1
If you have a question or complaint, please contact us.

14.2
If you are not satisfied with the handling of your complaint, you may have your dispute examined by the European Commission’s online dispute resolution platform at http://ec.europa.eu/consumers/odr/.

14.3
If you consider an item purchased from us to be defective and we do not agree, you may also refer the matter to the National Board for Consumer Disputes (ARN), Box 174, 101 23 Stockholm, www.arn.se. We participate in the dispute resolution process and follow ARN’s recommendations.

15. WEBSITE CONTENT

The Website and all content thereon belong to Seger or our licensors. All use of the Website or its content (including but not limited to copying, distribution, or storage of copyright-protected material or trademarks), other than for personal, non-commercial use, is prohibited without Seger’s express permission.
